• RETAIL TOBACCO BUSINESS LICENSES REQUIRED BEGINNING JANUARY 1, 2020 
• TOBACCO PURCHASING AGE INCREASED TO 21 EFFECTIVE OCTOBER 2, 2019

The Town of Breckenridge recently passed ordinances regulating the licensing of retail tobacco businesses and increasing the minimum legal sales age to twenty-one (21) years of age. The ordinance implementing the new Retail Tobacco Business License application, fee and regulations within Town limits was approved on August 27, 2019, with an effective date of January 1, 2020. The Retail Tobacco Business License application will be available by November 1, 2019 with the fee due January 1, 2020.

If you are selling or distributing tobacco products, you are operating a Retail Tobacco Business.
"Tobacco Product" is any product containing, made of, or derived from tobacco or nicotine that is intended for human consumption or is likely to be consumed, whether inhaled, absorbed, or ingested by any other means, including but not limited to, a cigarette, a cigar, pipe, chewing tobacco, snuf, or snus; any electronic smoking device, and any substances that may be aerosolized or vaporized by such device, whether or not the substance contains nicotine; any component, part, or accessory of a device, whether or not these items contain tobacco or nicotine, including but not limited to filers, rolling papers, blunt or hemp wraps, hookahs, and pipes.

Each Retail Tobacco Business location must apply for a Retail Tobacco Business License and pay an initial licensing fee of $600.
Tobacco Products shall not be sold or transferred to any person under the minimum legal sales age of twenty-one (21) years of age.
No refund shall be made to any Licensee who discontinues business during the licensing year and no License shall be transferable.

All Retail Tobacco businesses must also obtain a Town of Breckenridge business license by January 1 of each year.
