The Town of Breckenridge 2013 Marijuana License Ordinance (Ordinance No. 35, Series 2013) was developed in conjunction with State law to accommodate both medical marijuana centers and retail medical stores. The location and operation of medical marijuana centers, marijuana retail stores and grow operations are strictly regulated through the zoning process. This comprehensive dual application review process for marijuana licenses follows both state guidelines and our local application process, which require background checks for all operators, extensive security features, safety and signage measures and minimum setbacks from schools, day care centers and residential uses.
History:
On November 7, 2000, Colorado voters approved an amendment to the State Constitution to allow the medical use of cannabis. The Town of Breckenridge’s medical marijuana zoning ordinance was initially adopted in 2009 in response to inquiries for new businesses to sell medical marijuana locally. On November 6, 2012, Colorado voters approved Amendment 64. In 2013, The Town of Breckenridge repealed and readopted Ordinance No. 35 of Breckenridge Town Code to include regulation and licensing for retail marijuana stores in addition to medical marijuana centers.

When will I be able to purchase Marijuana legally?
Marijuana will be available for retail sale beginning 1/1/14.
How old do I need to be to buy marijuana?
You must be 21 years old or older to purchase, possess, display, transport or consume recreational marijuana.
Where can I consume marijuana legally?
Consumption of marijuana may be allowed in private locations providing it is not prohibited by the property owner.
The Open & Public consumption of marijuana is not allowed in the following locations:
- Any public lands, grounds or outdoor areas, such as public ways, streets, sidewalks, alleys, parking lots, or playgrounds
- Common areas of building usually open to the general public
- Any other outdoor areas open to the general public
Can I smoke marijuana at work or in a bar?
You cannot burn, smoke, inhale vapors or in any other way consume marijuana in any place of business.
Can I consume marijuana in a vehicle?
You cannot have open containers or consume marijuana in a motor vehicle located on public property or a public right of way.
Can I sell marijuana?
Selling marijuana to another person for a price is illegal.
What is the penalty for violating marijuana consumption laws?
Consumption violations will result in a mail in fine of $100. Subsequent violations will result in escalating fines & penalties up to a $2,000 fine and 15 days in jail.
