Land Use Guidelines and Overlay Districts
Land use guidelines (LUGs) have been adopted for the Town and surrounding areas by the Breckenridge Town Council. To promote the health, safety and general welfare of the community, all developments shall be reviewed against the land use guidelines and, where applicable, an approved master plan for the development of the property. (Ord. 22, Series 1994).
Included below are the Land Use District Map (delineating the specific Land Use Districts) as well as Land Use District Guidelines for each District. Please note that certain areas are affected by specific Overlay Districts, which also regulate land use; therefore, the Overlay Districts have been included in the links below.  In addition, many areas within the Town of Breckenridge are also regulated by one or more Master Plans, which would therefore impact the interpretation of a particular Land Use District.

Cucumber Gulch Overlay District:
In February, 2000 the Breckenridge Town Council adopted the Cucumber Gulch Overlay Protection District to further protect one of the Town’s most valuable environmental resources.  Cucumber Gulch contains forested areas and an extensive high quality wetlands complex.  The area also serves as wildlife habitat for many species, including numerous birds, moose, beaver, and the endangered Boreal Toad.  A Preventative Management Area (PMA) is designated for the heart of the Gulch (typically extending 300 feet out from open water bodies), where development activities are generally not allowed.   A series of best management practices are prescribed for any activities occurring in the Overlay District (e.g., use of fertilizers, pesticides, and herbicides is prohibited, limitations on pets on trails).  Below is a link to the adopted Cucumber Gulch Overlay Protection District.

Downtown Overlay District:
In July, 2007 the Breckenridge Town Council adopted the Downtown Overlay District ordinance.  The Downtown Overlay District is intended to maintain the vibrancy of the commercial downtown core area.  Within the District generally no new residential uses are allowed on the ground floor of any building.  The Downtown Overlay District applies to almost all of North and South Main Streets downtown, along with select blocks of Lincoln Avenue, Ridge Street, and Washington Avenue.  Below is a link to the adopted Downtown Overlay District.

STR Zone Mapped Areas:
New Short Term Rental Zones were adopted by Town Council in 2022, and are administered by the Finance Department. These zones are described as a Resort Properties Zone, a Tourism Zone (Zone 1), the downtown core (Zone 2), and single family residential areas (Zone 3). Short term rental licenses are capped and regulated by Zone.  More information on the Town's STR Rental Zones can be found here.
